Litigation, Bankruptcy and Creditors' Rights
John’s practice primarily focuses on commercial litigation and creditors’ rights issues. His extensive experience includes representation of bankruptcy trustees, court-appointed receivers, corporate creditors and debtors and those who wish to purchase assets out of bankruptcy. John also has a diverse civil litigation background including representing corporations and individuals in the construction, steel, manufacturing, insurance and real estate industries.
Some of John’s recent experience includes representation of:
- A Chapter 7 Trustee in the management and litigation of more than 100 adversary proceedings for fraudulent transfer and preference claims arising from a multi-million dollar Ponzi Scheme.
- A Chapter 11 Trustee in the administration and liquidation of a real estate portfolio.
- A court-appointed Receiver in the management, foreclosure and related litigation of a commercial retail shopping center.
- An insurance agent in the defense of fraud and negligent misrepresentation claims relative to a § 419A collectively bargained employee welfare benefit plan.
- A manufacturer in the litigation of molder’s lien rights and related sale of plastic injection molding equipment.
- A steel fabricator in litigation of commercial leases for industrial construction equipment.
- A real estate developer before the Ohio Board of Tax Appeals.
In addition to extensive experience practicing in state and federal courts, John has also served as counsel to public and private corporations regarding corporate structuring, sale of assets and tax planning.
John is admitted to practice in Ohio, as well as the United States District Court for the Northern and Southern Districts of Ohio.
