Our litigation practice group is composed of lawyers with substantial experience in the successful resolution of disputes. Our experience spans a broad range of commercial and regulatory matters, including antitrust, construction, contract, business, employment, fraud, creditors’ rights, class action and shareholder litigation.
In addition, we are experienced in representing national broker-dealers, clearing firms and individual brokers in state and federal court as well as arbitration before the NASD, NYSE and AAA. In several cases we have obtained dismissal of claims for alleged fraud, unsuitability, breach of fiduciary duty, breach of contract, violation of industry rules, defective research and negligence.
Our recent successes include:
- Obtained dismissal based upon applicable statutes of limitations in securities arbitration.
- Resolved an action which sought to hold an officer of a bankrupt corporation individually liable for corporation’s debts.
- Successfully represented an ousted company president and shareholder in a fraud action against an acquiring shareholder.
- Represented the State of Ohio Department of Insurance in formulating, presenting and obtaining approval of an insolvent insurance company’s rehabilitation plan.
- Obtained temporary restraining order preventing dissident shareholders of a publicly held company from voting their shares at a shareholder meeting in violation of contractual obligation.
- Successfully represented medical supply company and lessor of MRI equipment against hospital/lessee that breached long term equipment lease.
- Obtained seven figure award in California arbitration against Fortune 100 company in claim involving breach of contract and fraud in the sale of an aerospace subsidiary.
- Obtained summary judgment for Fortune 5 finance company against ERISA claims for unpaid salary and health benefits brought by employees of balloon manufacturing company.
- Gained multiple victories in injunction cases brought to enforce anti-competition clauses in employment agreements.
- Successfully defended CEO of a well-known Ohio company against a takeover attempt by his investor group.
- Successfully defended newspapers against claims of defamation.
- Obtained dismissal of “tech wreck” cases against national broker-dealers and individual brokers based upon claims of unsuitability and fraud.
- Dismissal of all claims against clearing broker and defense award of attorney fees against claimant and his counsel.
- Represented national broker-dealer and broker against claims by broker’s wife who alleged fraud, theft and mismanagement of inheritance.
- Successful representation of New York artist wrongfully induced to invest as limited partner in a fraudulent hedge fund.
Kohrman Jackson & Krantz is regularly involved in trials and arbitrations.
